Which compliance certificates do I need to obtain?

  • Electrical certificate

This certifies that the electrics on the property comply with the required safety standards.  Neither party can waive or contract out of this requirement.

It is generally the seller’s obligation to obtain this certificate but the parties can agree that the purchaser takes on this responsibility.

  • Electric Fence

This certificate is only required if there is electric fencing at the property.

Generally an existing certificate may be transferred by the seller to the purchaser unless a change has been made to the installation of the fencing since the certificate was issued.

  • Gas

This certificate is only required if there is gas installation at the property.

This certifies that the gas installation at the property comply with the required safety standards.  Neither party can waive or contract out of this requirement.

A new gas certificate must be obtained every time there is a change of ownership at the property and this is generally the seller’s responsibility although the parties can agree for the purchaser to be responsible for obtaining this certificate.

  • Plumbing

This is only applicable to transfers that fall within the municipal jurisdiction of the City of Cape Town.

This certifies that the water installation at the property comply with the municipal and building guidelines. Neither party can waive or contract out of this requirement.

A new certificate must be obtained every time there is a change of ownership at the property and it is the seller who is must submit this certificate to the City of Cape Town prior to transfer.

  • Beetle

This certifies that wood on the property is free from certain wood-destroying beetles.

Whilst parties can contract out of this requirement the bank from whom the purchaser is seeking to obtain a bond may require it and then it must be obtained at the purchaser’s expense.
